We are making changes to certain agreements (listed below) that govern your relationship with PayPal. These changes will be made automatically on the relevant dates specified below. Please send your contact information, the company`s website URL and a brief summary of your activities to aup@paypal.com To remind merchants who use PayPal to receive payments for commercial transactions, PayPal began on December 11, 2018 to give certain customers without an account the ability to send payments to merchant accounts using other local payment methods. To this end, Section 3.1 of the Terms of Service has been amended PayPal to clarify how additional terms of use apply to merchants when they integrate features into their cashier/online payment platform designed to allow an unaccounted customer to send a payment to the merchant`s account. This includes the PayPal agreement on local payment methods. As of the date of this announcement, Section 3.1 applies (and will continue to apply) from the Effective Date. Compliance with data protection laws. With respect to all personal data processed by PayPal and Merchant under this Agreement, PayPal and Merchant are each a data controller with respect to such processing. PayPal and Merchant agree to comply with the requirements of data protection laws applicable to Data Controllers with respect to their respective services and otherwise in connection with this Agreement. For the avoidance of doubt, PayPal and Merchant each have their own independently established privacy policies, notices and procedures for the personal data they hold and are each a data controller (and not joint data controllers).

Note on changes to the Acceptable Use Policy PayPal. This section is now titled „Pre-approved payments (also known as automatic payments)” with further changes for clarity. If a currency conversion is required, it will be performed at the transaction exchange rate we have set for the relevant currency exchange. The exchange rate of the transaction is adjusted periodically and includes a currency conversion fee charged and held by us at a base exchange rate to form the rate applicable to your conversion. The base exchange rate shall be based on the rates prevailing on the wholesale money markets on the date of conversion or on the preceding business day; or, if required by law or regulation, the relevant government benchmark(s). The exchange rate applicable to your conversion may be applied immediately and without notice. You may have the option (depending on the country/region you live in and the type of funding source) to decline currency conversion before completing the transaction by selecting Other conversion options on the „Verify Information” page at checkout. If a currency conversion is offered by PayPal at the point of sale, the exchange rate applied to the transaction will be indicated to you before authorizing the payment transaction.

By authorizing the payment transaction, you agree to currency conversion based on the exchange rate. If a currency conversion is offered at the point of sale by the merchant and not by PayPal and you choose to authorize the payment transaction based on the exchange rate and merchant fees, PayPal will not be liable to you for that currency conversion. If your payment is funded by a debit or credit card and involves a currency conversion by PayPal, you agree and authorize PayPal to convert the currency instead of your credit or debit card issuer. You agree to indemnify and hold PayPal harmless from and against any claim or demand (including reasonable attorneys` fees) made by any third party arising out of or arising out of: We have added a new definition of „information” because we protect the personal information of our individual users in the same way that we protect the information of our merchants (entities). The new definition is as follows: All PayPal users must read and accept agreements in the „Agreements for all users” column. If you use any of the services listed in the other columns, you must read and accept the applicable agreement(s). The above legal agreements and policies contain the terms and conditions of the specific services PayPal offers. Please note that in addition to the purposes set out below, PayPal will use your personal information to detect, prevent and/or remedy fraud or other illegal activity, or to detect, prevent or correct violations of applicable policies or user agreements. „15.7 Intellectual Property – Software License Grant.

If you use PayPal software, such as an API, developer toolkit or other software application, which may include software provided by or integrated with our service providers` software, systems or services, downloaded to your computer, device or other platform or otherwise accessible through your computer, device or other platform; PayPal and its licensors grant you a revocable, non-exclusive, non-sublicensable, non-transferable, royalty-free, limited license to access and/or use the Software PayPal in accordance with the Documentation, including all updates, upgrades, new versions and replacement software as described herein, for your personal use only. You may not rent, rent or transfer your rights in the Software to any third party. You must comply with the implementation, access and use requirements contained in all documentation, as well as any instructions we provide from time to time regarding the Services (including, but not limited to, the implementation and use requirements we impose on you to comply with laws and rules and regulations applicable to card schemes). If you fail to comply with the instructions, implementation and use requirements of PayPal, you will be liable for all damages suffered by you, PayPal and third parties. PayPal may update or discontinue any software after notifying you. Although PayPal may (1) have incorporated certain third-party materials and technologies into a website or other application, including their software, and/or (2) have accessed and used certain third-party materials and technologies to facilitate the provision of the Services, you have not obtained or retain any rights to such third-party materials. You agree not to modify, alter, alter, repair, copy, reproduce, adapt, distribute, display, publish, reverse engineer, translate, disassemble, decompile or otherwise attempt to create the source code derived from the Software, materials or technologies, or create derivative works of the Software or materials or technologies. third. You acknowledge that all right, title and interest in and to PayPal Software are owned by PayPal and that all third-party materials incorporated therein are owned by PayPal`s third-party service providers. Any other third party software application you use on the PayPal Website is subject to the license you have agreed with the third party that provides you with that software. You acknowledge that PayPal does not own, control or be responsible for any third-party software applications you use on any of our websites, software and/or in connection with the Services. If you use the Services on the PayPal Website or any other website or platform hosted by PayPal or a third party and you do not download any PayPal software or use any third-party software applications on the PayPal Website, this section does not apply to your use of the Hosted Services.

Unless we tell us otherwise, you may not use or attempt to use your account while it has been suspended or closed. You must ensure that all agreements with sellers or other third parties involving payments initiated by third parties (including payments for billing agreements) set up from your account are terminated immediately upon termination, suspension or closure of your account. You remain responsible, to the extent of such user greed, for all fees and other amounts incurred using your account at any time, regardless of termination, suspension or closure.
