The judge in that case, the President of the Family Division, Sir Andrew MacFarlane, provided the first legal definition of a mother. It ruled that the „mother” or „father” of a child is not necessarily gendered and that a person`s sex may differ from their status as a parent. Mr. McConnell`s case and the case of neutral parenting raise important questions about what information should be on a birth certificate and why: Although a „mother” must currently be registered, there is no legal requirement to have a father on the birth certificate. In the case of a same-sex couple, a second mother may be registered, but only as a „parent” and not as a mother. We have represented clients in the past who have tried to include their deceased partner on a child`s birth certificate, when they unfortunately died before the child was born. Currently, the Office of the General Registry requires a court order to do so, adding another layer of stress to an already difficult time for a new parent. Historically, of course, this has been associated with being a woman. The judge ruled that the definition should remain the same, even though it is medically and legally possible for a person recognized as a man to become pregnant and give birth. On that basis, Mr. McConnell was to be registered as the mother of his son. The McConnell decision will be disappointing for many non-traditional families, and many see the decision as a gross violation of human rights. The Birth Registration Act does not reflect the reality of modern society as a whole, and not just for transgender parents. The government needs to think deeply about how to address this issue and ensure that birth certificates are legally and factually accurate. The rules on who is the legal parent of a child are set out in the Filiation Act. The legal parent of a child is not automatically responsible for that child. And the person responsible for a child is not always the legal parent. If you are responsible for a child, you have the right and duty to educate and care for that child.

However, the judge acknowledged that the „social and psychological reality” of the father`s relationship with his child is not in accordance with the law in that country. 471. For example, a family living near Bristol recently reported in the national press their decision not to disclose their child`s sex and to raise them as gender neutral. When they became parents, Jake and Hobbit decided that this was the only way to mitigate unconscious gender bias and that they would let their child, Anoush, choose their own gender when they were old enough. This also applies to marriages and registered partnerships. Like a marriage, a registered partnership is solemnly entered into by a registrar for births, deaths, marriages and registered partnerships (burgerlijke stand).
